Rafael completed his Law degree in the year 2000 from the Complutense University of Madrid. He became a member of the Illustrious Bar Association of Santa Cruz de Tenerife in 2001 and completed his linguistic training by working for two years (2001-2002) in Frankfurt Am Main in Germany.
He specialises in Civil Contract Law; analysing complex contracts in sales transactions – specialist in Horizontal Division Property Law and and has obtained the status of collegiate property manager.
For over 10 years he has become highly experienced in the nullity of investments and banking contracts (convertible bonds, derivatives, structured, swaps, multi-currency, unit link, investment funds, Popular shares, etc.
Rafael is one of the first lawyers in Spain to sue and win Banco Santander for money lost in investments that were managed by the financial guru and pyramid fraudster Bernard Madoff, with Judgment No. 254/2015 of the Plenary Session of the Supreme Court in January 12, 2015. With this Judgment the Supreme Court modified a part of the Jurisprudence regarding the nullity of financial investments in protection of retail investors.
He is the first lawyer in Spain to obtain the nullity of the contracts known as “Valores Santander”, issuance of convertible bonds of Banco Santander of 7,000 million Euros with Judgment No. 30/2013 of the Provincial Court of Tenerife in January 24, 2013. This also represents a milestone since in a single sentence the lawyer managed to cancel 6 financial contracts: preferred shares, investment fund and Santander Securities, along with two personal loans granted by the bank to buy those products and finally two guarantee contracts on the financial products where the bank guaranteed the loans.
In the most recent years ha has remained focused on the demands of nationwide nullity bank investments, giving advice to consumers in the claim of abusive clauses in mortgage loans in the Canary Islands and in giving legal advice in the sale of plots and construction of villas in Abama Golf in Tenerife South.
